Terms and Conditions
PRICE VALIDITY & RESERVATION POLICY


  • All prices valid from April 1st, 2013 to March 31st, 2014, unless otherwise noted.

  • Prices however could be changed without notice. All prices are in U.S. dollars, net, and are non-commissionable unless mentioned otherwise and include all taxes.

  • All prices for sightseeing and services are given on a "per person basis" unless otherwise mentioned.

  • All rates are inclusive of any local, State and Federal government taxes.

  • Surcharges may also be charged for operational cost increases such as, but not limited to, fuel, and/or third party attraction rate increases.


Reservations


  • Starting point for all tours: Harlem Spirituals / New York Visions terminal at 690 Eighth Avenue (between 43rd and 44th Streets) New York, NY 10036. Except for the private tours in limousine for which the starting point will be the client's hotel.

  • Meeting time: 15 minutes prior to tour departure.

  • Sightseeing tours are on a sell and report basis unless requested otherwise.

  • Customized tours are available upon request.

  • HS/NYV Tours: Children's rates are valid for children of ages 5 to 11; tours are free for children 4 years and under if they are seated on parents' lap, unless otherwise noted.

  • Tours can be conducted with a maximum of two languages per bus.

  • Changes or cancellations must include HS/NYV booking number and must be sent by email. HS/NYV will acknowledge changes and/or cancellations within 24 hours.

  • Passengers must call HS/NYV 24 hours prior departure date to reconfirm their reservation. Passengers can call the Reservations Dept. 7 days a week from 8:30am to 7:00pm except Sunday until 3:00pm.

Vouchers


  • Operators will be invoiced on the basis of confirmed reservations and not just on vouchers redeemed.

  • Vouchers for the Harlem Gospel Tour on Sunday must mention clearly: "Shorts, Tank tops, and Flip-flops Not Allowed." HS/NYV reserves the right to refuse clients who are improperly dressed and will not refund the service.

  • Vouchers for all services must include HS/NYV telephone number: (212) 391-0900. They must include: Tour code and/or tour name - Number of adult and child passengers and passengers full name/s - Date/year of tour.

  • Vouchers must clearly state 'booked and payable by Harlem Spirituals".

  • Vouchers with incomplete information or invalid tour codes/names will not be accepted. Passengers will be asked to pay for their tours on-site and advised to return their vouchers to issuing office for a complete refund.


Transfers


  • If the passengers do not see the driver they must call 1 800 660 2166 immediately.

  • Maximum waiting time after the landing of the flight is 1 hour and 15 minutes thereafter additional fees of $90 an hour or part will be invoiced.

  • For all arrival changes on a transfer on the day of the transfer must be made by phone and followed by a fax or e-mail. Penalties could be applied for changes made on the day of the transfer.

  • The full price will be invoiced if flight information or airport information are not correct and/or in case of flight delays.


Additional Information for Transfers


Vouchers: Clients must receive 2 vouchers for the services + 1 for the evening option


Clients must receive 1 voucher for the transfer from the airport to their hotel.


Transfers by Shuttle


Attention: Passengers will have to present the voucher to the driver; without it they will have to pay the service in cash to the driver.


The voucher must include the following information in English:



  • Issued to: GO Airlink NYC

  • Please Provide: "SHARE-RIDE VAN"

  • Name(s) of Passenger(s)

  • Day & Date of Service

  • Hotel Name and Location

  • Payable By: Harlem Spirituals,Inc.

  • Voucher No. (Please fill in.)


Upon arrival at the airport, passengers must go to the "Ground Transportation Desk", also called "Information Desk", located near the "Baggage Claim", and show their voucher to the agent. The shuttle will arrive within 15 minutes. If there is no agent at the desk, passengers will have to use the phone next to the desk and dial #18.


Included 1 luggage +1 bag per person. Passengers carrying additional luggage will be charged directly at the drop off. Passengers cannot follow a driver whose shuttle doesn't display the "Go Airlink" logo.


Transfers in a private car for our packages with hotel or the service a la carte (My Sedan)


Attention: Passengers will have to present the voucher to the driver; without it they will have to pay the service in cash to the driver.


The voucher must mention the confirmation number of the service and the following information in English:



  • Issued To: Go Airlink/My Sedan

  • Please provide: "One Way Transfer in private Sedan/SUV

  • Booking #:

  • Name(s) of Passenger(s):

  • Day & Date of Service:

  • Hotel Name and Location

  • Payable by: Harlem Spirituals,Inc.


The driver will wait for the passengers at the "Baggage Claim", and will be carrying a sign with passengers' names. If the passengers don't see the driver they must call 1 800 660 21 66 or the (212) 434-0400 after 7 :00pm. The service won't be reimbursed if passengers leave the airport without contacting us first.


Please note: the car will be dispatched 30 minutes after the flight has landed, a maximum of 1h15minutes of wait is included. If the driver has to wait longer, an extra fee of $90 an hour will be charged.


Included 1 luggage +1 bag per person.



  • 1 global voucher for the package upon arrival. 1 envelope containing the coupons, vouchers as well as the program and useful information will be handed to the passengers.

  • 1 global voucher for the evening option


CANCELLATION POLICY

Harlem Spirituals/New York Vision Sightseeing tours


  • More than 3 days prior: no charge.

  • 2 days prior: $15 per person per tour booked and confirmed

  • Less than 24 hours: 100% will apply.

  • No shows: 100% will apply.

  • All changes and cancellations must be sent by email and reconfirmed by our reservation department to be valid.

  • Services may be canceled or changed due to circumstances of force majeure and will not be subject to refund.


FIT Services (not valid for Niagara Falls Excursion, Shopping Tours, 1 day excursions on the East Coast and Broadway Shows)


  • More than 15 days prior: no charge.

  • 14 to 8 days prior: 25% for total services canceled

  • 7 to 2 days (48hrs) prior: 35% total services canceled

  • Less than 2 days: 50% of total will apply.

  • Less than 24 hours: 100% will apply.

  • Same day cancellation and No shows: 100% will apply.

  • All changes and cancellations must be sent by email and reconfirmed by our reservation department to be valid.

  • Services may be canceled or changed due to circumstances of force majeure and will not be subject to refund.


Special Services


  • Theater tickets: non-refundable regardless of time of cancellation.

  • See Niagara Falls page for additional information.

  • 1-day East Coast Excursions: less than 3 days: 100%


Niagara Falls


  • Clients must call Harlem Spirituals (1-212-391-0900) 24 hours prior to the departure date to reconfirm the meeting time and place.

  • Morning transfers will be offered from any Manhattan hotel above 14th street and below 70th street. For clients outside of this area, the pick up will be at the New York Hilton and the Towers Hotel on 6th Avenue and 53rd St, Clients will have to go to the pick up location on their own.

  • If they do not see their driver the morning of the tour, clients must call immediately (1-888-888-6075). Contact must be made in order to authorize taxi reimbursement.

  • All reservations have a limited capacity and are on request basis.

  • There is a 21-day cut off period for all reservations.

  • The rates indicated are negotiated for a certain type and number of seats. Due to airfare variations, if this number is exceeded, a surcharge will apply to air transportation and in this case a cancelation fee of 100% will apply.

  • Passports are mandatory for non-US citizens to enter Canada. Visas may be required for certain countries and must be delivered in country of origin before departure.

  • All reservations must have each passenger's full name and his/her birth date. Without information, airline may refuse issuing tickets. This is a new federal regulation for air travel for all airlines.

  • Flight cancellation will not result in reimbursement of the tour. The supplier will take full responsibility of arranging clients' return transportation. If clients choose to return to NYC by way of public motor transportation such as Greyhound bus instead of flying back and paid out of pocket, we will fully reimburse the bus fare.

  • Flights may be cancelled or delayed due to inclement weather conditions. If and when flights are cancelled due to reasons out of HS/NYV's control, HS/NYV cannot be responsible for accommodation in Buffalo; it will be the responsibility of the client.

  • A 50% cancellation fee will be apply for all regular reservations cancelled within two weeks and up to 5 business days prior to departure. There is no exception to this rule.

  • Full price will apply to all cancellations within 5 business days prior to departure.

  • Any reservations agreed at higher rate than normal will be subject to an immediate full cancellation fee.

  • We will not be able to change dates if clients miss the flight.

  • Last minute name changes will incur a fee of $100 per name (within 2 weeks prior).

  • All group reservations will require a 20% pp deposit when booking a group. Full names are due to 30 days prior to departure. Full payment is due 30 days prior to departure. All cancellations made within 30 days of departure will result in complete forfeiture of the monies paid.

  • HS/NYV is not responsible or liable for any traffic delays during transfers, flight delays by airlines and any misconduct by its vendors.


Packages with Hotel


  • More than 30 days: no charge will apply

  • Less than 30 days: 100% will apply.

  • No shows (including Force Majeure): 100%

  • Any luggage left at the luggage storage room during the stay, upon arrival or departure will be charged directly to the client.

  • If the minimum number of participants is not reached, the departure will be cancelled or deferred. In that event, Operators will be notified at least 28 days before the scheduled departure.

  • Services can be cancelled or modified due to Force Majeure circumstances and will not be reimbursed.

  • Except special circumstances, we will not be able to deal with a complaint received 30 days after passengers have returned.


Packages without Hotel


  • More than 30 days: no charge will apply.

  • 29 to 22 days: 10% will apply.

  • 21 to 15 days: 15% will apply

  • 14 to 2 days: 25% will apply

  • Less than 24h: 100% will apply

  • No shows (including Force Majeure): 100%

  • Any luggage left at the luggage storage room during the stay, upon arrival or departure will be charged directly to the client.

  • If the minimum number of participants is not reached, the departure will be cancelled or deferred. In that event, Operators will be notified at least 28 days before the scheduled departure.

  • Services can be cancelled or modified due to Force Majeure circumstances and will not be reimbursed.

  • Except special circumstances, we will not be able to deal with a complaint received 30 days after passengers have returned.


COMPLAINTS AND CLAIMS


  • Claims must be filed within 30 days of the last service booked with Harlem Spirituals, Inc.

  • Any claim received after 30 days will be processed at the discretion of Harlem Spirituals, Inc.


PAYMENT POLICY


  • Net 30 days upon receipt of invoice for credit approved accounts.

  • No-shows and applicable cancellation fees will be invoiced on the basis of operator booking. Invoices must be paid in full. Failure to adhere to payment policies will result in cancellation of agreement and vouchers not being accepted.

  • Past Due invoices will incur a 2% late fee charge.

  • Pre-payment is due 10 days before arrival or floating deposit for all other accounts until credit has been approved.


Bank transfer:

A $25 bank transit fee will be added to all wire transfers

RESPONSIBILITY

HS/NYV assumes no liability or responsibility for traffic conditions, access to sites or other conditions beyond its control or for any injuries, damage, delay, inconvenience, additional costs incurred for any reason beyond its control.


Force majeure

Harlem Spirituals Inc. shall not be liable for any failure to perform its obligations where such failure is as a result of Acts of Nature (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalization, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity [or telephone service] or any other cause reasonably beyond the it's control making the service commercially impracticable, impracticable to perform, illegal, or impossible to fully perform under this Agreement as the Parties originally contracted. In such Harlem Spirituals Inc. may terminate this Agreement, without liability.


HS/NYV reserves the right to substitute equipment as needed and/or substitute routes in case of weather, street closures and special events (i.e. parades, street fairs, etc.). Circumstances beyond HS/NYV control may result in itinerary changes or cancellations; Changes or cancellations will be sent in writing with as much advance notice as possible. Passengers presenting a voucher issued by Operator prior to receipt of change/cancellation notice from us will be offered a similar tour or additional services representing the value of the tour originally purchased.
